The planning proposal is seeking to review and update the applicable Local Environmental Plan controls for rural and large lot residential areas along Browns Creek Road and Forest Reefs Road.
A request was made to extend the plan relating to existing holding provisions and minor administration changes.
The proposed amendments include:
- Transfer all land which is currently zoned 1(c) Rural Small Holdings under the Blayney Local Environmental Plan 1998 in the vicinity of Forest Reefs Road, Millthorpe, to R5 Large Lot Residential under the Blayney Local Environmental Plan 2012 with a Minimum Lot Size of 2 Hectares.
- Transfer all land which is currently zoned 1(c) Rural Small Holdings under the Blayney Local Environmental Plan 1998 on Browns Creek Road, Blayney, to R5 Large Lot Residential under the Blayney Local Environmental Plan 2012 with a Minimum Lot Size of 20 Hectares.
- Extention of time specified in Clause 4.2A(4) of the Blayney Local Environmental Plan 2012 from three to five years.
- Creating opportunity for applications to be lodged through the ‘Existing Holding’ provisions of Clause 4.2A until November 2017; if you had an existing holding in the RU1 zone prior to the Blayney Local Environmental Plan 2012 LEP being legislated.
- Undertake minor administrative and clarification amendments including: Boundary Adjustment.
- To incorporate into the Blayney Local Environmental Plan 2012 a new standard instrument boundary adjustment clause to permit minor boundary adjustments in rural areas on lots below the minimum lot size and/or greater than 10 per cent variations in lot size.
- An administrative update that will correct a ‘gap’ in current controls.
- Amending Clause 4.2A – Erection of dwelling houses or dual occupancies on land in certain rural protection zones - Subclause (3)(c) to add the words ‘under an environmental planning instrument’ before the words ‘before this Plan’.
- Intention is to clarify dwelling rights only extend to environmental planning instruments (LEPs and Interim Development Orders).
The relevant documents will be on display at the council offices until July 7.
